Introduction
These Terms of Service (“Terms”) govern your use of DJ Tony’s services. By booking DJ Tony for your event, you agree to these Terms. Please read them carefully.
1. Definitions
– “DJ Tony” refers to Tony Sullivan, the service provider.
– “Client” refers to the individual or organization booking DJ Tony’s services.
– “Services” refer to DJ Tony’s DJing, music, and related entertainment services.
2. Booking and Payment
– A non-refundable deposit of $250 is required to secure the booking.
– The remaining balance is due at the time of signing the contract or prior to the event, as specified in the agreement.
– Payment methods accepted include credit card, PayPal, and bank transfer.
3. Cancellation and Refund Policy**
– Cancellations made more than 30 days before the event will result in a full refund of any payments made, excluding the non-refundable deposit.
– Cancellations made within 30 days of the event will result in forfeiture of all payments made.
– DJ Tony reserves the right to cancel services with a full refund if unforeseen circumstances prevent performance (e.g., illness, equipment failure).
4. Liability and Indemnity**
– DJ Tony is not liable for any indirect, incidental, special, or consequential damages arising out of the use or inability to use the services.
– The Client agrees to indemnify and hold DJ Tony harmless from any claims, damages, or expenses arising from the event, including but not limited to, personal injury, property damage, and equipment loss or damage.
– DJ Tony is not responsible for any interruptions or failures caused by external factors such as power outages or venue restrictions.
**5. Equipment and Setup**
– DJ Tony will provide all necessary DJ equipment for the event.
– The Client must ensure the venue provides adequate power supply and space for equipment setup.
– Any damage to DJ Tony’s equipment caused by the Client or their guests will be the responsibility of the Client.
6. Music Selection and Requests
– DJ Tony will work with the Client to create a playlist tailored to the event.
– While requests are welcome, DJ Tony reserves the right to refuse requests that are deemed inappropriate or disruptive.
– The Client acknowledges that not all requests can be accommodated due to time constraints or other factors.
7. Force Majeure**
– DJ Tony is not liable for any failure to perform due to circumstances beyond his control, including but not limited to natural disasters, acts of terrorism, or government restrictions.
– In the event of a force majeure, DJ Tony will make reasonable efforts to reschedule the event or refund payments made, excluding the non-refundable deposit.
8. Photography and Video**
– DJ Tony reserves the right to take photographs and videos during the event for promotional purposes, unless the Client explicitly requests otherwise in writing.
– Any images or videos taken by DJ Tony may be used on his website, social media, and marketing materials.
9. Privacy Policy
– DJ Tony respects your privacy and will not share your personal information with third parties without your consent, except as required by law.
– Personal information collected will be used solely for the purpose of providing DJ services and communicating with the Client.
**10. Amendments**
– DJ Tony reserves the right to amend these Terms at any time. Any changes will be communicated to the Client in writing.
11. Governing Law
– These Terms are governed by the laws of the state in which DJ Tony operates. Any disputes arising from these Terms will be resolved in the courts of that state.
12. Acceptance of Terms
– By booking DJ Tony’s services, the Client acknowledges and agrees to these Terms of Service.
